1. Acceptance of Terms
By accessing and using Pahincho, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
You must be at least 13 years of age to use this service. If you are between 13 and 17 years of age, you represent that you have your parent or legal guardian's permission to use Pahincho and that your parent or guardian has read and agreed to these terms on your behalf. By using Pahincho, you represent and warrant that you meet the applicable age requirement.
2. Description of Service
Pahincho is a platform that connects users for sharing, borrowing, and requesting items within their community. Our service facilitates peer-to-peer transactions and communications between users. The platform uses a points-based system (Pinchos) to facilitate transactions and ensure accountability.
3. User Responsibilities
Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. Users must provide accurate and truthful information when creating listings or making requests. You are responsible for:
- Maintaining the security of your account credentials
- Providing accurate and up-to-date profile information
- Ensuring items you list are accurately described and in safe, working condition
- Communicating respectfully with other users
- Returning borrowed items in a timely manner and in the same condition as received
4. Prohibited Activities
Users may not use the service for any illegal activities, to harass other users, or to violate any local, state, national, or international law. Fraudulent listings or requests are strictly prohibited. Additionally, you agree not to:
- Post false, misleading, or deceptive content
- Impersonate another person or entity
- Violate any intellectual property rights
- Interfere with or disrupt the service or servers
- Use automated systems to access the service without permission
You may not list or request the following items on Pahincho:
- Illegal substances, drugs, or paraphernalia
- Firearms, weapons, or ammunition
- Items subject to safety recalls
- Prescription medications or controlled substances
- Counterfeit, stolen, or fraudulently obtained goods
- Hazardous materials or substances
- Items that require a special license to own or transfer
- Perishable food items
- Any item whose listing or transfer would violate applicable law
Important Security Notice: Never share sensitive personal information such as credit card numbers, social security numbers, bank account details, or passwords through the in-app chat or messaging system. Pahincho will never ask for this information through chat. Always use secure, official channels for any payment or verification processes.
5. Item Conditions and Safety
Users must ensure that items shared or borrowed through the platform are in safe, working condition. Pahincho is not responsible for the condition, safety, or functionality of items exchanged between users. Borrowers are responsible for returning items in the same condition as received, and owners are responsible for accurately describing item conditions.
6. Profile Verification
To enhance trust and safety on our platform, we offer profile verification. Depending on the verification level required, you may need to:
- Verify your email address
- Verify your phone number by receiving and entering a one-time SMS passcode
- Add a valid credit card to your account (for identity verification purposes only — Trusted tier)
- Add a profile photo
- Complete government ID and selfie verification through our identity verification provider, Didit (ID Verified tier — required to borrow higher-value items)
Phone verification SMS: By entering your mobile number and requesting a verification code in the app, you consent to receive an SMS one-time passcode from Pahincho (via our SMS provider). Message and data rates may apply. These messages are for account verification only, not marketing. Reply STOP to opt out; reply HELP for help.
ID Verified (Didit): Completing government ID verification is optional unless you want to borrow items above our higher-value threshold. By starting ID verification, you consent to Didit collecting and processing your government ID images and selfie (including liveness and face-match checks) solely to verify your identity. Pahincho does not store your ID photos or selfie images as primary records; we store the verification outcome and related session metadata on your account. ID verification is free to you at this time.
Important: We do not charge your credit card for verification. The credit card information is used solely to verify your identity and establish trust within the community. No charges will be made to your card for the verification process. Your credit card information is securely stored and processed through our payment processor in accordance with industry standards.
Penalty handling: Borrow accountability uses pincho collateral held during a rental. Saved cards are for identity verification only and are not charged for penalties at this time. We will notify you if this policy changes.
7. Points System (Pinchos)
Pahincho uses a points-based system called "Pinchos" to facilitate transactions. Points may be earned through various activities on the platform and are used as a form of currency for borrowing items. Points are non-transferable and have no cash value. Pahincho reserves the right to adjust point values, implement penalties for violations, and manage the points system at its discretion.
8. User Content
By posting items, images, descriptions, or other content on Pahincho, you grant Pahincho a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and providing the service. You retain ownership of all content you post.
You represent and warrant that you have the necessary rights to post any content you submit, and that such content does not violate any third-party rights or applicable law. Pahincho reserves the right to remove any content that violates these terms or that Pahincho determines, in its sole discretion, is otherwise objectionable.
9. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, PAHINCHO PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PAHINCHO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Pahincho shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including but not limited to damages for loss of profits, data, or other intangible losses. Pahincho acts as a platform connecting users and is not responsible for:
- The condition, quality, or safety of items exchanged
- Disputes between users
- Loss or damage to items during transactions
- Any injuries or damages resulting from the use of borrowed items
10. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding the collection and use of your personal data. By using Pahincho, you consent to the collection and use of information as described in our Privacy Policy.
11. Account Deletion
You may request deletion of your account at any time through the app settings. When you delete your account, the following information will be permanently removed:
- Your profile information (first name, last name, email address, and location)
- Your profile image
- All items you have posted
- All requests you have made
- All associated data including notifications, wishlists, and transaction history
Account deletion is permanent and cannot be undone. Once your account is deleted, you will not be able to recover any of your data or content.
12. Modifications to Terms
Pahincho reserves the right to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days advance notice prior to any new terms taking effect. Your continued use of the service after any changes constitutes acceptance of the new terms.
13. Governing Law and Disputes
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or your use of Pahincho shall be resolved exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.
Before initiating formal legal proceedings, you agree to contact us at support@pahincho.com to attempt to resolve the dispute informally.
14. Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the terms. Upon termination, your right to use the service will immediately cease.
